Hi All, I have a query regarding whether a worker covered under the ESIC Act in Himachal Pradesh is eligible for sick leave as per the Holiday and Festival Act applicable in Himachal Pradesh. In this regard, can anyone share details of the section where it is mentioned that sick leave is not applicable if a worker is covered under the ESIC Act? I need this information urgently. Please share as soon as possible.

Sick Leave for ESI-Covered Employees
If the basic Act (the state Shops and Commercial Establishments Act, which is an Act to regulate the conditions of service and to ensure the welfare, health, and safety of workers employed) has provided for sick leave, you are supposed to give it to all employees, including ESI-covered employees. In respect of such employees, invariably, you are not paying wages for the days they remain on ESI leave.
