I have been appointed as the Investigating Officer in a domestic enquiry. The charged employee never attended the enquiry despite being given three reminders. Can I proceed with an ex-parte enquiry? What are the formalities to be observed before and during an ex-parte enquiry? Please guide.

On the next scheduled date, you can initiate the ex-parte proceedings by stating, "The employee charged with misconduct was absent on previous dates (mention specific dates) and despite being informed to attend the enquiry via postal receipt and acknowledgment (if available), did not show up. I waited for 30 minutes, but the employee did not appear, hence I proceeded with the ex-parte proceedings."
The management representative present before me was given the opportunity to present their evidence. The management representative provided me with the names of two witnesses:

Following this, you can begin recording the statements of the management witnesses. At the conclusion of their statements, you can note that since the delinquent employee is not present, there is no need to provide an opportunity for cross-examination. At this stage, you may still ask formal cross-questions.
