Hi, our gratuity amount under CTC is included and has been deducted at 4.81% of the basic pay. However, I am leaving the job before completing 4 years. Therefore, I am inquiring if I am eligible for a gratuity amount refund. Please let me know if there is any law that allows the refund of the amount before 4 years.

You are not eligible for any gratuity as you are leaving service before completion of 5 years of service.

But said amounts are in my salary, amounts which were agreed upon at the time of joining the company and deducted from my salary. If there is any law regarding challenging the recovery of said amounts in a period less than that specified in the Gratuity Act, please advise.

Gratuity and CTC Clarification

First of all, the gratuity amount cannot be added to the CTC, and it cannot be deducted from the salary of any employee. Gratuity is a reward given to an employee upon leaving the service, whether due to retirement or death, as a recognition for their long service.

The company concerned can obtain an insurance policy for gratuity for its employees to reduce their burden of payment. In this case, if an employee leaves the service, retires, or passes away, the payment will be taken care of by the insurance company if the employee is eligible for gratuity.

If the gratuity amount cannot be added to the CTC and it cannot be deducted from the salary of any employee, how do the employees come to know that they need to withdraw the same? Gratuity is deducted from my CTC every month; it's not added to the gross, but it's included in the CTC.
