My query regarding LTA is as follows:

Our company considers LTA payment from April to March. An employee goes on maternity leave from April to July and does not return after completion of 3 months. The company pays salary for July and August. She resigns on 14th October but does not serve the notice period. In fact, she hasn't served the company in the current financial year. Is she eligible for LTA? How would the pro-rata calculation of LTA be worked out?

Need a reply ASAP, please.

Dear Trishna,

If the employee has been confirmed with the company, then you will have to pay on a pro-rata basis. The calculation is as follows: Annual LTA/12 X number of months in service for that financial year.

Also if the employee has not served notice period than you can deduct salary in lieu of Notice period while doing FULL N FINAL Settlement. Regards Ashish

Dear Jayachander,

If the salary is paid in that financial year and kindly refer to Trishna's query (Leave was adjusted & there was no loss of pay. Salary from April till August is paid to the employee), so the employee is eligible for LTA.
