Dear All, We wish to hire some fresh and experienced people in our company. Over the next year, we will train them in our products. Some of them will be sent abroad for training as well.

Legal Agreements for Employee Training and Non-Compete Clauses

My question is, in India, can we:

A. Make a legally binding agreement so that if we are training a person, including foreign trips, they cannot leave the company for, let's say, a period of 3 years?

B. Make an agreement so that whenever they leave the company, they cannot solicit to hire our current employees, approach our customers, suppliers, or more directly, and most importantly, work with our competitors for at least a period of, let's say, 3 years?

Please let me know your knowledge and experience about this.

Thanks.

Documents for Employee Agreements

The documents you're referring to are as follows:

1. Undertaking/Agreement Between Organization and Employee – copy attached.
2. Should be included in the contract or code of ethics & conduct – use the search key. I am sure you will find this information on this site; if not, please Google it.

I hope this is the proper answer to your question.

Regards

Please let me know how to prepare a non-compete agreement for employees not to join a particular company/client for at least 1 year after his/her termination.
