Dear Seniors,

I have completed 8 years and 7 months of service and am leaving the organization. The administration is prepared to pay the gratuity; however, they require a copy of the act to expedite the process. Could someone please assist me in identifying the specific act or rule under which this falls, and where I can obtain a copy of the same?

Thank you for your prompt reply. To the best of my knowledge, the act is applicable to our organization. I tried searching the website of the Government of India, Finance Department, but could not find specific details. Our department is seeking clarification on the act that stipulates eligibility for gratuity for employees who have completed 5 years or more.

Dear Mr. Girish,

The Act should be available on the Law Ministry's website. Alternatively, you can search for the Payment of Gratuity Act on Google. You will definitely find it there. This Act contains provisions stating that employees who have completed five years of continuous service are eligible for gratuity.

Probably, the Act may also be available on Citehr.com itself.

Dear Friends,

Kindly clarify my doubts on ESI. One of our employees is working in the Bangalore branch office, and his date of joining is June '10. Our head office is in Chennai. He has admitted his father to an ESI hospital for surgery. He does not have his ESI permanent card. Therefore, we obtained his ESI temporary card online and provided it to him along with Form 105 and 37. We acquired his online temporary card using the Chennai user ID. However, in the Bangalore ESI office, they are requesting proof of his current employment confirmation with us, Form 5 from his date of joining, his salary details, and his contribution details. Is this the standard procedure? Have we done anything incorrectly? Kindly clarify.

Dear Girish Ji,

Printed copies of the Payment of Gratuity Act, 1972 are available in the market. Please buy a copy and give it to your office for reference. Just ensure that the copy you buy is the latest version and covers any amendments, such as the increase in the ceiling from 3.5 to 10 lakh from 24-05-2010. In metropolitan cities, you can easily find a copy.
