Is there anyone who can help me with the following topics?
When do we need to submit the monthly return by the 25th of the following month using Form 12A along with Form 5 and 10 (if applicable) and a copy of the challan?
Do I also need to submit the list of employees along with the individual contribution details of the employees as well as the employer (PF, EPS, and EMP-PF) with the 12A monthly return?
Please also inform me whether the monthly return is submitted in a single copy or in duplicate. If it is submitted in a single copy, what records should we keep?

No need to submit individual contribution details of the employee and employer, and submit one copy of 12A, 5, and 10 along with a covering letter. Please take a receipt acknowledgement on another copy of the covering letter for your reference.

Thank you, Atul, for your valuable information. Can you please clarify about Form 10? Let Company has a total of 50 employees in the month of Apr'2011. On the 15th of May 2011, one of them left the company. We are required to submit the return by the 25th of June 2011. Please advise if we should submit Form 10 in the month of June 2011 return by the 25th of June 2011 along with 12A (as his contribution is for 15 days in May 2011), or should it be submitted when we file the return for the month of June 2011 in July 2011.

Left employee’s details will be submitted in June, 2011. Always remind that when anybody leave d job u must submit form 10 in return month. Keep it up. Kalpesh

If an employee left in May (1st to 31st), we should reflect this in the June Form 10 returns only. Why are you waiting until June 25th? We should prepare the challan on June 1st or 2nd and then remit the challan by June 6th or 7th. Submitting the returns earlier would be more efficient.

- Form 5: To submit the monthly PF return which includes new employee details.
- Form 10: To submit the monthly PF return which includes details of employees who have left.
- Form 12A: This form is used for the same purpose and contains consolidated details of that particular month, including new joiners, employees who have left, and employer-employee PF contributions.
- Form 3A: Used for annual PF returns.

Hi,
I wanted to know if a person leaves the organization without any notice and without any exit interview formalities, i.e., absconding, will the person get the provident fund without any support from the organization? Only if he has his PF details. If yes, what is the procedure, whom to contact, and where?

Hi Leena,
If any company does not shore up for withdrawing PF, an employee can directly submit his office to the PF office by attesting his bank manager's signature. He will have to get the signature of his bank manager on Form 19 & 10C and submit it to the PF office.

It is the duty of the employer under the Act & Scheme to help Employees' Provident Fund organization to settle the Provident Fund dues of his employees. He has to complete the prescribed application within 5 days of receipt [para 72(5)] forms & hand it over to the member when he leaves the service. When a member finds it difficult to get the form attested by the employer, he can get the attestation of any of the following officers & send it to the Provident Fund office:
- Manager of a bank.
- Any gazetted officer.
- Member of the Central Board of Trustees/committee/Regional Committee (Employees' Provident Fund Organization).
- Magistrate/Post/Sub Post Master/President of Village Panchayat/Notary Public.
