Hi all,

This is regarding Maternity benefit. I am working in a management institute affiliated with a recognized university. My appointment is ad hoc, and I have been working there since August 2006. I want to know if I am eligible for maternity leave as per the Maternity Benefit Act. Also, my PF deduction is being done.

Can anyone tell me what the scope of this act is and if I can fight for maternity leave if I do not receive it?

Hi,

As per my knowledge, yes, you are totally eligible for availing maternity leave under the Maternity Benefit Act of 1961. The act applies to every woman employed directly or by way of contractors as well.

However, there are below-mentioned points which you need to ponder on:

1. Please ensure that you have worked with the employer for a continuous period of 80 days in the past 12 months.
2. Ensure that your salary is more than ₹10,000 per month. If less than this, you can avail maternity benefits only under the Employee State Insurance Act of 1948.

Thanks for clarifying this. Another thing I want to know is what does 80 continuous days mean? Will it include casual leave and other gazetted leaves?

Also, please tell me, if I don't get the maternity leave despite fulfilling the conditions, then how should I proceed? Where should I lodge my complaint?
