I have one query; kindly share your opinion on this. Our premises are covered under the Contract Labour Act and Building and Other Construction Workers Act. I have studied that the BOCW Act does not clearly specify the overtime limit for construction workers. Kindly let me know if there is any time limit for OT hours.

Under the CLA Act, what is the maximum working hours for security services, including OT, per day? Are there any laws requiring them to work for 12 hours per day? Kindly share this information with me. Your help regarding this matter is very urgent.

Dear Puttaraju.M,

To have complete knowledge of OT working, including hours of work, spread over, rest intervals, and OT working limits, we should go through both the provisions and rules under the applicable Act and Rules for your unit. The rules provide us with the procedure for working on OT.

In my opinion, the Contract Labour (R&A) Act, 1970, and the Rules do not have provisions relating to OT working. If the establishment is covered under the Minimum Wages Act, 1948, then please refer to the OT working provisions under the Act and applicable Rules.

Dear Sir,

I am looking for construction work site HR. We need to obtain BOCW registration in the CG state. My question is, what is the frequency of construction site cess payment? In our work order, payment of cess value needs to be ensured every month, totaling 1% of the RA bill submitted to the principal employer. This is a private construction work site under a private company.

Kindly provide your valuable suggestions. Also, could you please share the BOCW compliance checklist, acts, and rules that we need to ensure on a month-to-month basis?

BMK - BOCW Cess is applicable only on the Cost of Construction. You can sit with your finance and procurement team to understand and elevate the cost and present the same to labor enforcement to get approvals, and submit the same to your principal employer.

Puttaraju - The act clearly states 48 hours in a week for Central or State. However, there is an exemption for Telangana with 72 hours in a week with constraints.
