Hello, I am a Human Resources professional from London. My company has opened a new office in India, and I am required to set up a new Provident Fund for the employees.

Does anybody have information on how I can do this? Which companies should I talk to?

Hi Mitesh,

You can directly deduct 12% from the employee and 13.61% from the employer, and make a DD for the same in the name of SBI A/c EPF A/c. Then, you fill out the PF Form 9 for the employee's name and submit it to the PF Authorities. You will receive the PF No. within a month.

Otherwise, you should contact the Employer Federation of South India at . If you contact this email ID, they will help you.

Dear Mitesh,

If your company is opening a branch in India, it would be better for you to conduct an interview and appoint a person as HR (from that area) who will take care of all legal matters, including PF, due to the many formalities in government offices. Another option you have is to consider consultancy or outsourcing.

Sir,

Please visit the EPFO website or contact your local PF office to submit the application for EPF code along with the list of employees, wages, date of joining, and relevant documents such as company/office address proof. They will contact you within a week to start working on this issue. You can also directly contact the PF inspector in your factory office area.

It is really true that you need to appoint an HR person who can handle all HR activities in India. Dear Mitesh,

I can help you with PF matters provided you have opened an office in New Delhi. Please note, all employees whose basic + DA (Dearness Allowance) salary is less than Rs. 6500 are required to be covered under this act. Moreover, even those drawing more than this can also be provided with this facility, but it is not compulsory for them.

All organizations using power and employing a minimum of 10 employees need to apply for the PF Membership. In case you do not use power, a minimum of 20 employees is required.

Dear Mitesh,

Fellow citehr members have given you a lot of advice; further, I want to highlight a few points.

- In the case of India, employers do not have to set up Provident Fund. There is an Employees Provident Fund Organisation set up by the government under the Provident Fund Act, and employers have to register with EPFO and complete all the compliances and payments of contributions. This registration is not very difficult, and one can use the services of consultants or even do it on their own.

- Apart from PF Registration, there will be other registrations and compliances needed such as ESIC, Professional Tax, Factories Act, Shop & Establishments Act, etc. I suggest you ensure all compliances from day one. Maybe you can negotiate a package with a legal consultant for all compliances.
