My company is telling me that they will not issue the relieving letter because I have not served the notice period of 3 months after resignation. Is it mandatory to serve the notice period? You may have signed the terms and conditions of your company, which include their notice period details. Hence, you are expected to abide by them. Any irregularity in this could cost you a normal relieving letter. However, you should receive an experience certificate from your ex-employer, and you may take legal action if it is denied.

Don't worry about the relieving letter if your current employer is ready to proceed without it. If you really want it, simply pay the notice period amount and obtain the relieving letter (only the basic pay of the balance days will have to be paid). If it's not required, you can leave it and enjoy your new job.
