I have resigned from my company and want to be relieved within 15 days to start a new phase of life. I am leaving my IT career and transitioning towards community development by joining the internship at Community Health Cell - Community Health Cell - ANNOUNCING THE COMMUNITY HEALTH LEARNING PROGRAMME (CHLP)-2009.
The fellowship is starting on May 4th, and I have very few days to provide the company as notice period (15 days) compared to the standard 2 months. In our company, HR does not initiate exit formalities unless the manager agrees, and unfortunately, my manager is not consenting to a smooth relieving process. I have offered to work during late evenings and weekends to complete my pending transition, but my efforts have been in vain. I am left with limited options (apart from an unclean exit) as this fellowship holds significant value for me. As I am prepared for a new career path, I do not foresee returning to the IT field in the future, making the work experience certificate or relieving letter less important to me. However, I would like to inquire about the possibility of receiving my PF in the case of an unclean exit. If so, how can I proceed? Additionally, what will happen to my IT Form 16?

Dear,
Legally, they are bound to give you Form 16. If they refuse to do so, you can make a complaint to the income tax authorities or consult a CA for that. There is no problem getting PF, regardless of the type of exit. If the employer refuses to verify your form, you can fill up Form 19 and 10C and deposit the same with the PF office with a cover letter stating that your employer is harassing you and not attesting your form. It is the responsibility of the PF department to get it attested from the employer and release your fund.
