We all know that it is mandatory to close offices on the day of voting, and there is a legal penalty for opening the office on that day.

If we give time off to employees on the voting day, can we compensate for it by having them work on another day?

Early response would be highly appreciated.

In my state (Odisha), voting has already been completed. We received a circular from the labor office to close the factory on that day. However, as we are in a manufacturing unit, instead of declaring a holiday, we provided flexibility to our staff and workers. Those in the A shift were allowed to vote in the second half, and those in the B shift voted during the A shift without any issue for the C shift. For the general shift, we offered flexibility for them to arrive late or leave early after working half a day. We cannot compel anyone to work and close the unit on that day. If we were to enforce attendance, they would have the right to lodge a complaint with the labor office as it is declared a national holiday.

Gentleman, Politician want us to be alive until date of polling and we vote them.....;) After that they don’t bother for next five years whether we are dead of alive...:p Rashid

There should be at least a half-day leave for voting as it is our fundamental right. Our daily lives depend on the ruling government, so we should have a say in choosing the government. Blaming the wrong and corrupt leaders is of no use if we do not vote. Going beyond voting should be mandatory for everyone.

Employees are entitled to take up to two hours of paid leave. They may also take an additional two hours of unpaid leave, if necessary, to have four consecutive hours off while the polls are open.

As per the "Negotiable Instruments Act," all employees of the organization should be given a minimum of 2 hours off on polling day so that they can cast their votes. It is at the organization's discretion whether they want to provide a full day off or declare it as compensatory time off.

In order to ensure that the work schedule is not disrupted due to this unplanned holiday, we will be working a full day on Saturday, May 9th, in lieu of taking the day off on polling day.

Dear,

Basically, it is a paid holiday. Now, it is up to you to follow or not to follow the law. Even the Election Commission of India has given instructions to declare it a closed holiday. When it is declared as a paid holiday, how can you work in lieu of that?
