Hello Everybody.

I need your advice.

We have decided to terminate an employee with immediate effect due to non-performance, behavioral, and attitude issues. Our offer letter states that during the probationary period, if the employee's services are found unsatisfactory, he will be terminated by giving one month's notice or Salary in lieu of notice.

My question to you is, can I terminate this employee with immediate effect by giving him one month's salary in lieu of notice without any legal consequences? The employee is in his probation period.

Dear Eugenie Greetings! If there is agreement that termination is warranted, employment should be terminated and the employee may be given one week’s pay in lieu of notice of termination.

Whatever the terms of employment may be, before termination, the facts behind the same should be established, and the employee should be given a fair chance to defend himself. The principles of natural justice are to be followed, and then accordingly, you may proceed.
