Dear Friends,
As per the Act the ESIC has to pay the benefit. Management need not to pay any thing. However, it is left to discretion of the Management to pay or not to pay. Some Management out of way help its employees.

An employee who works in an establishment which is covered under ESI act and the employee is also covered is not eligible for getting salary while he is on ESI leave and if paid, the corporation will ask the employer/employee to refund the amount, since enjoying double benefit is not allowed.

hello dear.
Gone through your problem.
First let me know does company is having any policy in case of ESI coverage employee to meet with shortage of salary to be paid by company. In certain company it is paid as furlough allowance to meet with remaiinig amount of salary.
If you do not have such policy in that case you need to pay any thing if accident occured during working hours and if you have sent ACCIDENT REPORT TO ESI authority.

Plz confirm whether the employer contribution towards ESI is 4.75% on gross salary & employee contribution is 1.75% on gross
