Seedhi si baat hai yaaro double benefit:SL and ESIC leave can't avail any employees,If he/she covered with ESIC. If he/she covered under ESIC, but not avail the benefit of ESIC rules and employeer are interested to pay SL, than no objection to any one.

Re: eligible for SL or not I agree with Mr.Rao. Employee can not enjoy dual benefit. Pl. refer your company standing order or leave policy it will be clearly reflecting. BR.Mohan GM-HR

I partially agree with mr.KM.RAO, dual benefits barred by labour laws but i disgaree with th view that it should be provided which means if the company knowingly (as a welfare measure) pays in addition to ESIC it is not barred.

An employee cannot enjoy double benefit at a time. If he is availing the sick leave benefit of ESIC then he cannot claim for SL under co's leave policy. I strongly agree to the comments of Mr. K.M.Rao.

I agree with Mr. Rao, he will not be eligible for SL if ESIC is taking care of it, if ESIC is not doing any such payment (in case of very short leave) then employer has to take care of it within the bindings of the policy of the company about SL
