Hi Experts,
if a company has a notice period of 3 months and the candidate is seeking a sooner release, is the company legally capable to force the candidate to work for 3 months notice period. I mean if the candidate is ready to go for a buy out, then also can the company refuse it and force the candidate for 3 months notice period.!

The employee can very well pay 3 months notice pay as per the appointment clause and walk out of the company but how ever it depends on the task that the employee is working on, if he is working on some important task For Eg as a project manager and he is the only one who knows complete details of it and its not possible to hire a new manager within short span and explain him the work from the beginning then surely the company can force the employee to work till the assigned task gets accomplished.

Legally it is not possible if it is mentioned in the clause that the employee can leave the organization by service the notice period for three months or by paying three months notice pay.
