Hi ,
I would like you to tell me if appointment letters and contracts are one and the same thing or they are two individual documents ?
I am of the opinion that appointment letters are the same as contracts but our legal advisor differs. Please give your comments on the same.
Thanks
Mods ::: Sorry for double posting. I have posted this in HRM topic as well didn't know it's more apt here in this section.

Hi Neha
Appointment letter is permanent whereas contract is for fixed period or for certain task. In appointment letter notice period is there but in case of contract notice as well as contract is comes to close on its expiry of the terms.

Hi Arun,
Thanks for replying. Could you please elaborate on what are the contents of both ?
In my opinion the appointment letter should contain details about CTC and certains terms and conditions.
What should the contract entail ?

Hello
Contract Letter is an agreement letter between employer & Employee. The contract is written down and both are agreeing to it. The contract is signed basically for a certain task or project with time limit, benefit & other details Specified.
Appointment letter is also similar letter but under appointment the employee is direct under Company employment & is mostly for long term employment, here the employee is applicable for all the benefits under Co. rule & regulations.
Appointment letter is generally given after completion of probation period, depending upon the performance review
I hope this solves your query

Dear All,
Let me try to remove doubts if any . Letter of employment is also a contract between an employee and the employer based on terms of employment as may be specifed at the time of joining or may be amneded from time to time between an employee and an employer which is to be further read with different statue as may be applicable depending upon classification of an employee - worker, staff and management staff.
This contract is to be understood as either the Contract of Employment or the Contract for Employment in legal sense. The contract of employment is for open period whereas the contract for employment is for a spesified period .
Hopefully this has given some clarity . If you still need some clarification on this aspect of term , please do write to me at email :
With warm regards to all.

Hello,
It is not difficult to send some samples but shall request you to speak to your consultant who shall be able to give suitable draft . The reason for such suggestion is that contract differ based on classification of an employee and the industry . If used on the basis of sample , it may cause harm than good to you or the company as the same is legally binding on both the parties . Hopefully , you understand the implication of such a decision.

Dear Folks.
I think to a a large extent B. B Rajpal is right. However the significant difference also stems from the entitlemnts. While in most cases the contract terms turn out to consolidated. The appointment letter mentions few conditions since most of them are spelt out in the employees' handbook. Both document are legally bindining on both employers and employees.

Hi
Appintment Letter defines terms and conditions of appointment for regular employees and maynot have an end date defined. Though sometimes companies may define a retirement age and limit the appointment ot that date. However a contract is a term based association and ceases on the specified end date. Contract needs to be renewed whereas appointment letter does not.
