* Right to seek exemption from the applicability of the Scheme in case benefits provided by the management is similar or superior to those available under the ESI Scheme.
If there is some provision related to this then kindly let me know the procedure for availing exemption.

Dear Freind,
This exemption from the applicability of the Scheme is granted if you are providing benefits to your employees similar or superior to those available under the ESI Scheme in all respect.
The exemption granted has to be extended periodically, I thing every year, by making an application.
It is not easy to get this exemption. You can not grant all benefits at par with benefits under ESIC in all respect. To my knowledge, or it was told to me that, only TATA has this exemption at Jamshedpur.
