Hi ! This is Bablesh Kaushik. The company I work with intends to engage some skilled workers on Fixted terms contract for one year.The individual is requesting not to deduct the PF. His basic & SA is above 6500/-.
Kindly suggest that how to go ahead and ensure that PF liability does not come to the Company.

Dear Bablesh,
If the employee is not any PF member till now, you can get the get the form 11 filled from the employee and submit the same to the PF office. There will be no liability on the company.
But if the employee is already a PF member, then you will have to deduct the PF or otherwise take him as a consultant, while deducting only his TDS.

Yes even they can be taken as consultants. Give them all the employee benefits, but as consultants. This will help you solve the problem.
