We are havng E P F Code , We have 60 regular employees. Apart from these 60 employess we have 300 numbers of workers supplied by labour contractor. He is alo having E P F Code. For our regular employees we are contributing 12% of Full wages (I.e if salary isRS 30000 we contribute RS 3600. Ther is provision that we have to contibute 12 up to the celling of Rs 6500. Now we want to contribute up to Rs 6500 for he workers supplied/employed through contractor. Can we do this.

Hi Sitram
You can deduct EPF on the Ceiling limit of Rs.6500.00, by showing the employee basic salary as Rs.6500.
Firstly as have already deducted on Rs.30000/- and deposited, you have put up a letter to the commissioner of PF stating the facts that you wrongly deducted on whole of the salary paid, now want to deduct on the basic salary or on the ceiling limit only. You have take prior permission from the commissioner of PF.
You show other part of the salary i.e 23500.00 towards allowances of any nature.

Dear Sitram, As per my knowledge, PF benefits can not be reduced. So you can not reduce PF salary. In new joining you can deduct PF on max. 6500/- Basic. Regards, Jony_M

As I understand from your query, you are allowing PF contributions on actual salary for the 60 odd employees. Let this practice continue.
You have a large workforce employed through an independent contractor who has a separate Pf Code No.
He can deduct PF from the salary of his employees, restricting it to the limit of Rs.6500/- provided under the Act, for his employees under hisCode No. You only need to ensure that the contractor is complying with PF and provisions of other labour laws.

Dear Sitram,
About the contractor's people you need not to worry as the contractor is capable for the same when he withdraw the pf number.you can keep an eye on the contribution deposit.
For your people (60) you can have your own structure, but always keep in mind that the ctc sheet will have no impact of your basic salary as the cost will remain the same as you put 6500 or 30k as the increased cost will reflect on the cost sheet.

Dear All,
I am working in Construction Industry.
We engaged a labour contractor who is not having PF code and having a labour strength of 60 numbers. He pays wage salary of Rs.300 per day, which has monthly salary of Rs.7800 of which he takes basics salary Rs.6700. My doute is
1. Whether he has to comply PF statuary, since PF celling is Rs.6500.
2. Incase if he engage 3 more labours in future at basics salary of Rs.6000/-. Can he obtain PF code for only these three labours or he need to go for all 63 labours.

Hello Sitaram,
From the text of your message it appears that u hv a separate code for ur own employees and the contractor has separate code in which he is complying the PF matters of his labor force. Since u are the principal employer the onus is on u to ensure that the contractor is remitting the PF amount regularly. You ask the contractor to submit a xerox copy of challan and a copy of monthly return 12A to you regularly every month. Your responsibility is upto this. The contractor is a different company and he has his own payment structure abt which u have no responsibility.
