Ours is a manufacturing company which runs round thet clock ( 3 shifts). I have a doubt. requested clarification. An employees weekly off fell on a paid holiday (Public Holiday). due to exigency of work, he was asked to do over time. How to compensate his paid holiday and weekly off and extra wages, as per Factories Act. Please Yagniah K

Hi As per the factories act, if a employee works on public holidays in the sense of (National Holiday) He is eligible for a day (off) and one day payment (This is normal payment as he is eligible for comp off also) And the overtime wages as to be calculated as it has been done for the normal cases The only difference between working on a Sunday and Public holiday is for Sunday work the employee will be getting a comp off within 3 days (Either prefix or suffix) where as in case of Public holiday work he gets one day off and one day payment and if he does the OT , the OT payment is as usual (double the rate of standard rate) Hope you will be clear Regards R Sudhakar
