Hi,

Our employee approached me regarding his date of birth correction.
Facts of the question:
As per his school records, D O B is 14-06-1975. But according his Births and Deaths Register Office Certificate (recently got the certificate from government authorities) is 09-07-1976 (actual DOB).

At the time of is school admission, due to ignorance of his parents, they told that his D.O.B. 14-06-1975 instead of 09-07-1976.

Is there any chance to correct his Date of Birth? If yes, please advice the procedure / channel.

First and foremost - The date of birth needs to be corrected in the school certificate. For this the employee needs to approach his school/school board and check whether the board accepts such corrections in the first place. Once such a correction is effected, there shouldn't be any problems to have the same reflected in the official records.
Some organizations record both the official date of birth and the actual date of birth.

Advise your employee to adopt the following procedure to implement the change of date of birth:
1) He should first notify the change of date of birth in least 2 prominent national newspapers, like, "The Hindu", "Times of India."
2) Get the change notified through Gazette notification of the Government of India.
3) Get the date of birth changed in the Educational Certificate from the concerned Board of Examination.
4) Apply for the change of DOB in the official records of the company.

Dear Venkat,
Proper procedure would be for the employee to approach a court for a declaration that the date of birth is 09-07-76.Supporting affidavit along with the birth certificate by the parents should be filed with the court.
Employer cannot rely only on the certificate of date of birth.

According to various judgments of hon'ble appex courts and diffrent high courts its clearly ruled out that " date of birth recorded in matriculation certificate duly authenticated by tha education board is conclusive proof of age and no other records including service records" WP(S) NO. 1193/04 JHARKHAND HIGH COURT FULL BENCH.
The agrreived person has to contact his education board for rectification of his date of birth via his school with his admission records. but i dont think the education board will entertain his rectification application at this stage. hence pl go through the date of birth as recorded in his matriculation certificate.
