We are a manufacturing company and had crossed 20 employees 8 months back and after realising this we registered for PF. We have now 28 employees. We now have received notice from PF asking why we are not registered in PF from the company incorporation date which is 12 years back. Please let me know was it mandatory to register in PF from incorporation date and how much will be the liability for late registering.

Once you have engaged 20 or more employees, it is mandatory to register your establishment under the PF even if you have no coverable employees. If non are coverable you are not required to remit any contribution. With regard to liability, you are liable to pay the contribution from the day when you have engaged 20 or more employees where in you have coverable employee/s to the extent of wages of coverable employee/s.

Take proper advice from a lawyer or good PF consultant.
The liability will be from the period you reached PF enrolment limit.
That is 8 months back as per what you have written.
For 8 months both the liability will have to be borne and after that employee will bear his part and you as employer will have to contribute.
How many employees are above PF limit of Rs15000 PM.All these details need to be looked into first.
This is just general advice giving your broad contours of likely liability+ any interest for the period and penalty etc if any.
