Dear All,
If some corporate hospital appoints a technician (lab/x-ray etc.) on part time basis/ Hourly payment basis or Work basis to avoid full time employment and to avoid falling in all labor issues.
What are the legal issues involved in this?
What are statuary obligations ?
What contact should contained ?
Can his appointment treated as "Consultant" and honorarium will be paid to him?

Part time employees are also covered by all statutory and social welfare schemes like ESI, EPF. They are also to be paid salary at the rate of minimum wages fixed by the govt. but it can be proportionately reduced to the hours worked.
A consultant is normally a highly skilled person and an X Ray technician is not like that and if you give appointment order as 'consultant' it will not be fair.
