Dear Colleagues,
I am working in a Real Estate Developing and Construction firm, looking after all the statutory requirements. We have registered ourselves in EPF And ESI and allotted the codes.
The client is asking us to register under Workmen Compensation Policy, I believe that as we are already covered under the ESI act this policy is not required. Pl provide ur valuable guidance.

Hi,
As per the ESIC act the employees whose salaries are up Rs.15000/- pm are covered under this act and those employees who are earning over and above Rs.15000/- shall be out of ESIC covereage hence it is better to cover those employees under WC policy.
You may deploying some supervisory & Engineers on the site to supervise /guide the construction activity and the risk in construction company is very high hence the client may be asking for the same. It is better for the client / employer to take preventive measures hence it is better to cover them under WC ( those employees who are out of ESI coverage).

Hi khatib,
Once your employees are covered under the ESI Act, 1948, it becomes the liability of the ESI Corporation to give benefits to the employees even in case of injury/death. Section 53 of the ESI Act imposes a bar against receiving compensation or damages under any other law. So, no need of WC policy.
Staff & supervisors may be covered under group insurance policies.
