Hi All,

Could someone kindly clarify the Election Day holiday regulations for private companies in India(Telangana State).

Is it possible for the private companies to continue operations, granting paid leave only to those eligible employees to vote? Kindly let me know.

In our opinion you are to grant paid holiday to the all the eligible employees in accordance with the provision of sec.135B of the Representation of people Act, 1951.

Hi

If Government had declared Holiday under Negotiable Instruments Act, 1881 then holiday should be declared by Private Companies. However the declaration of a holiday by the government under the Negotiable Instruments Act of 1881 will not be applicable to private companies falling under the Factories Act of 1948 as per Madras High Court ruling.

"granting paid leave only to those eligible employees to vote?" What do you mean by this. Is voting is not common for all employees?

My question is only employees with voting rights in their respective constituency elections are granted paid leave, while the rest continue their duties. This ensures smooth organizational operations, allowing all eligible employees to participate in casting their votes in their respective constituencies.

Is this the correct procedure?

Hi,

I hope you are meaning bye election in one particular constituency ?. In that case Govt will not declare State wise holiday and only for that District. In that case holiday not required for all employees.

In some states' Act governing holidays like Karnataka Industrial Establishments (National and Festival Holidays) Act, there is a provision for granting of holiday with wages for the employees to cast their votes in general elections and bye elections (to fill vacancy) to Lok Sabha and State Assembly. In other places there will be separate communication from the Chief Labour Commissioner in this regard. Earlier the practice was that employees should be given opportunity to cast their votes but when it was found that the 'opportunity' to cast votes remained in paper only but the same was not granted in practice, it was made mandatory that the establishment should declare it as holiday following section 135B of the Representation of people Act.

The Election Day is declared holiday by the Govt. for enabling the working people to cast their voting rights.
The day is a paid holiday for the employees casted their votes, they may be working in a Public, Private and Govt run companies in the state election is going on.

In continuation to above views of the experts, I would like to point out that on a continuous process industry where it is not possible to declare holiday, in many States employees are allowed by rotation 3 hours leave to cast their votes after the notification by the respective State Government.

Yes, that applies to such continuous operations with 24X7 running where a stoppage will result in huge loss and involve a lot of efforts to resume the operation.
