If some one covered under ESIC then employer is not liable to pay. She will claim from ESIC by showing that she was on leave without pay during that period.

Hi parvin, if any employee who is in service proceeds on maternity leave, ESI corporation will make the cash payment 100% if she fullfills the eligibility conditions.

If an employee is not covered under ESIC than the Maternity Benefit Act comes to play & accordingly the company is responsible to pay her for 84 days of materinity leave.
