where office ????? in railway or in a hospital ???/
If in India & not in emergency service then your management shoud be from other planet........
Your management can also say shifting this independence day to other day......that time you will again put a post for cite Hr mmembers that it is possible or not ??
Your mgtmt can say they will celebrate independence day when they will free...again you willask......
frankly ask your management really they know abt independence.........

Question is ruthless? Be an indian.
Feel proud to be an Indian. Then these questions will not arise in your mind.
You can work on even festival holidays if the employees accepts but not on national holidays eventhough the employee accepts.

Hi All-

We need to help Madhura, not by words, but by giving her relevant arsenal when she puts on a fight with her management. And trust me - all we are doing here is chatter chatter... nobody for that matter me as well - has mentioned any specific link / page / attachement which talk about:

1. Necessity of national holidays

2. Incase there is / isnt a necessity holiday, then what measures a org should be taking in either scenarios.

3. What does voilation of the national holidays, attract (punishment)?

And while we answer the questions above, or bring up new ones for answers, lets not talk gibberish and base our point by provinding basic fact verifyable by anyone.

Let help Madhura.... get this straight....

You can open office but have to follow the shops & establishment act 1954, 1st give the employees duble duty ot and also declare on day off in lieu of 15th aug, and submitted application to DDF office n have approval.
we can run on 15th Aug.

you can run on 15th Aug,09. provision already have to run office on national holiday just go thru Shops & Est. act 1954 in deep. u will find your answer. Thanx, niscy

Yes, three are three national holiday, 26th Jan, 15th Aug, and 2nd October.
Employees who are required to attend duty, are paid extra wages and a compensatory off.

This practice exist in all PSU's like SAIL, NTPC, Indian AirLines, ONGC, GAIL etc. etc.
Continous operations (whether in Private or Public sector) are run 24X7 and manned accordingly.

Have you ever seen a Police Station, Traffic Police, Electricity Distribution, Water Supply, Hospitals, Railways, Bus services, Airlines etc. etc. come to a dead stop on these national holidays ??????

Do you think they are not patriotic (some even being in Public Sector or Government offices) ????

Even in schools and colleges, students come for national flag hoisting, right ????

Equating patriotism with coming to work or attending duty - is it correct ????

Finding answers to these will clarify the issues. Many of the 'foolish' responses seems to have come from layman and not HR professionals, and have been made without thinking, introspection or observation of the surrounding environment and real issues. Instead of being blinded by false emotions, one should be objective and look around to update oneself.

Dear friend,
If at all required to be worked on National Holidays, the law says that two times of the normal pay (double OT) for the day and a leave to provided.
But before opting to keep offices open as normal, think of our nation and the sacrifices our forefathers had made, due to which we enjoy "what we want to do" today.

On 15 August 1947, India attained freedom from the British Rule. Every year, August 15 is celebrated as the Independence Day in India.

Dont disturb your Employee's freedom to celebrate this great Independence day.

Dear Friend,
As per law, you can not work on national holidays. Only those factories, which runs continuously for 24 hrs round the year only can work on these national holidays. But in case, you have no other option, but you have to open on that day, you have to get special permission from labour office and also give one day off within 3 days and also double salary for the day. It is a major violation under law if you open without the permission of labour office. So, it is better, you keep that day off.
