We had one employee who joined us as Software Engineer on March 2016. We didn't sent him confirmation letter( by mistake). This March his resignation came to us suddenly with a 15 days of notice period. As per policy we asked him to serve 60 days notice period but he said as he was on probation till date ( because of not receiving confirmation letter) so he will not serve for more than 15 days( as per our company policy). He also sent us a legal letter after which we terminated him before 15 days and didn't gave him relieving letter and salary for that month. He said he will complain against us in employment exchange and he will drag us to court. When he joined us he didn't provide his last company's relieving docs to us. He kept giving different reasons for not giving the docs. Wanted to know what are our rights and can we deny that because he has not given any docs before joining we are not going to give him relieving letter from our company.
