Could you please elaborate on how the Gratuity percentage is arrived at. I learn that it is the lump sum given at the end of the employment on resignation, death or disablement after 5 years. Is it deducted monthly??? what if an employee resigns after working for only 1 year? would he also be provided with gratuity amount?

The correct way to calculate the gratuity is as per the following formula:
15 /26 x GS x SER
Gratuity Salary (GS) Last drawn basic salary including dearness allowance (if any)
Gratuity Service (SER) Completed years of Continuous Service with part thereof in excess of six months.

4.81% for Gratuity is worked out on the following basis.
Assume the employee is drawing a wage of Rs.100/ month
100 X 15/ 26/ 12 will give you the Gratuity computation per annum. Further if you divide this by 12 (calendar months in a year) then you will arrive at 4.81%.
