Dear Professionals,

We are a textile background industry located in Tamil Nadu. We have an OT exemption form 25 B from the Inspector of Factories, and we maintain a separate OT register in our software system. So, is it mandatory to maintain a separate form 10 for the OT register instead of using the software system for IF records? Kindly clarify my doubts and do the needful.

Dear User,

Based on your query, you're looking for clarity on whether it's mandatory to maintain a separate Form 10 for overtime (OT) register, given that you already have an OT exemption Form 25B from the Inspector of Factories and are maintaining a separate OT register in your software system.

🔶 According to the Factories Act, 1948, which governs the working conditions in factories in India, every factory must maintain a register of adult workers (Form 10) employed in the factory. This register should include details of overtime hours worked by them.

🔷 While you are maintaining the OT register in your software system, which is a good practice, it's still legally required to maintain Form 10 in many states in India, including Tamil Nadu. This is because the law mandates the maintenance of a physical register for inspection purposes.

🔶 Here are the steps to maintain Form 10:
1. Record the name of each adult worker in the factory.
2. Note down the nature of their work.
3. Mention the hours of work including OT.

🔶 However, please note that there might be variations in the requirements based on the state laws. Some states may allow digital record-keeping while others may still require physical registers.

🎵 As you are located in Tamil Nadu, it's advisable to follow the Tamil Nadu Factories Rules, 1950, which mandates maintaining Form 10. However, if you have operations in Bangalore, you should adhere to the Karnataka Factories Rules, 1969.

🕅 It's recommended to consult with a local labor law expert or your legal team to ensure compliance with the respective state's Factories Rules.

🕵️ In conclusion, maintaining Form 10 is generally required as per Indian labor laws, even if you have an OT exemption and are maintaining a separate OT register in your software system.

Remember that compliance with labor laws is crucial to avoid any legal issues and to ensure a smooth operation of your factory.
