Understanding Leave Policy Formulation

As per the Telangana Shops and Establishments Act, we need to provide 15 earned leaves, 12 casual leaves, and 12 sick leaves. However, big companies like Wipro, Infosys, etc., offer 24 or 25 leaves per year. My company wants to understand how the leave policy is formulated and why it may not align with the Telangana Shops and Establishments Act.

Can someone please help me understand how to determine leave allowances for a private company based in Hyderabad? Should we follow the Shops and Establishments Act, or is it not necessary?

The minimum leave any establishment registered under Shops and Establishment has to give employees is mentioned in the Act.

If some company wants to give extra leaves and other facilities, there is no harm, and it will be a plus point for potential employees to join.

Companies are giving fewer leaves than mentioned in the Shops and Establishment Act, i.e., 15 earned leaves, 12 casual leaves, and 12 sick leaves. Hence, I want to understand, can we give fewer leaves than the stipulated ones in the Act.

As long as compliance with the S&A Act is acceptable, if not, it is a clear-cut violation that may be prosecuted by the Labour Department. As long as there is no complaint, things will be smooth. If there is any complaint, action shall be taken.
