I am Sushmitha, working as a Human Resource professional for a startup company. I am the only person in the HR department handling hiring, payroll, exit procedures for employees, and some HR generalist activities. I would like to request something from you all: in my company, we have started deducting PF and ESIC. The management is not willing to cover the employer contributions, so we have begun deducting both the employee and employer contribution amounts from their CTC. However, we did not mention this in their offer letters.

Salary Amendment Preparation

For this reason, we are planning to prepare a salary amendment for all employees. Can someone help me with this? I am unsure about the process. Please suggest what columns I should include; we believe we need to add benefits to this amendment. I am having some difficulty locating a salary amendment template. Your suggestions would be greatly appreciated.

Dear Sushmitha, your entire post creates a negative impression about your organization. As such, anyone would be obliged to think that your computation of the CTC and your current attempt to make amends are not due to ignorance of the law or an error of judgment, but only to hide the mistakes wantonly made. Therefore, naturally, no one would be inclined to explain the concept of CTC to your management nor the ethical implications involved in luring the employees. Neither your management's unwillingness nor their financial inability would be valid reasons for your failure to remit the employer's contribution under the laws you mentioned. In addition, such an act would amount to unauthorized deductions leading to recovery proceedings u/s 15 of the Payment of Wages Act, 1936 in case of its application or breach of the contract of employment. Better advise your management accordingly instead of trying to amend the salary already agreed.
