I was working with a Limited company located in Azadpur, New Delhi as GM (IT) since 2006. Last month, the chairman of the company called me into his cabin and forced me to resign without any reason, threatening me that he would file fake cases and police complaints against me based on false allegations and destroy my image in the market if I refused to resign. The chairman wants to frame corruption charges against me, which are clearly gibberish and fake. Therefore, keeping in view the instructions of the chairman, I had no choice but to submit my resignation instead of being humiliated at the workplace where I gave my best as an honest and loyal employee.

I have worked for 10 years and 6 months, and during my tenure, I received three promotions. Recently, I was promoted to GM (IT) in April 2016, and the chairman took only one minute to force me to resign immediately, despite having worked with full devotion and commitment without any illegal demands or pressure throughout my service. I stood by the company when it was going through a crucial phase (Father and Son's dispute/split).

I have already handed over the charge (list of passwords, and they are questioning the authenticity of the passwords, which they must have changed since November 2016), whereas the company's work has not been hampered and is running smoothly. Now, they are not at all interested in my full and final settlement.

Will you please let me know how I can file a case against the company?

Labour Court or Labour Tribunal? Or are both the same?

Your early action on the matter will be highly appreciated.

Mr. Saxena,

You cannot seek any remedy through any of the labor laws for the outstanding dues under any head other than the gratuity for 11 years of your service under the same employer by filing a claim under the Payment of Gratuity Act, 1972.

For other dues, if any, like unpaid salary, cash equivalent of earned leave at your credit, you have to institute a civil suit.
