Sir, I have been working for an architectural consulting firm since 1991. However, I have not been paid for the last eight months. My provident fund was started in 2003. I am concerned about the legal options available to me. Apart from the salary due for the last 8 months, I have not been paid approximately 10 lakh rupees in previous dues. Can I claim gratuity?

Yes, definitely, you can claim your outstanding salary for the last 8 months. You have stated that you joined in 1991, but your provident fund was started in 2003. Why is that? Did the company or you become eligible for coverage in 2003? More details are required to understand the situation.

Details of Outstanding Dues

What is the amount of dues totaling Rs. 10 lakhs? Please elaborate for better suggestions. You can claim gratuity only after the cessation of employment. Since you are still employed, you cannot claim gratuity. Depending on the details of the exact state of affairs, your nature of employment, etc., the proper legal course of action can only be suggested.
