Dear Seniors,
We are constructing a new office at a certain location. There are 13 contractors with a total of 150 people working on flooring, interior, and fall ceiling.
1) Do we need to register the contract now? (I am from Tamil Nadu)
2) What is the procedure for registration?
3) Last time I visited the ACL office to apply for a license for our current office, they asked whether the construction was ongoing or for an office separate process.
Please advise on the necessary steps to proceed.
Thank you.

Dear Mani,
This information is not enough. What is the total duration of this project? In which area will it take place - altering the current company, existing building, or constructing a new building?
You have to register under the Contract Labour Act to engage contract employees. A Registration Certificate (RC) will be issued by the Authority. Then, you have to inform each contractor to obtain a license if they engage 20 or more workers. Feel free to call me for any clarification.

You are constructing a building?
In the construction stage, you are covered under BOCW Act. Therefore, the registration and all formalities will need to be done under that act. You are also required to pay a cess based on the project cost.
After the construction is over, you need to follow the requirements of the Shop and Establishment Act. At that stage, the contract licenses would be required for those contractors who are working in the office.

Dear Mani,
Greetings of the day!
First, you have to register under the Contract Labour (R&A) Act 1970. For that, you are required to submit Form-I to the authority along with the challan copy (which will be available at the Labour Office).
If you are involved in construction, then you have to register under the BOCW Act. Otherwise, your contractor has to handle the registration with the BOCW authority.

Dear All,
Thanks, but this construction project is only for 2 months. We will be moving to another building for a 10-year lease. The construction work mentioned earlier includes flooring, carpeting, interior design, fire exhaust, and similar aspects. For this type of project, I also need to register under BOCW.
Thank you.
