My ex-employer based in NCR is refusing to pay my incentive upon exit. While resigning, I was assured that it would be included in the Full and Final (FnF) settlement. It is also mentioned on my salary slip. However, it was never credited to my bank account. I have tried emailing the Labour Commissioner but received no response. I have my salary slip as proof, but they are denying it. Can anyone please help or suggest something?

Understanding the Situation

It is crucial to address the situation promptly and effectively to ensure your rightful incentive is received. Here are practical steps you can take to resolve this issue:

1. [🔗 Contact HR]: Reach out to your ex-employer's HR department directly to discuss the discrepancy in the incentive payment. Provide them with a copy of your salary slip clearly showing the incentive details.

2. [🔡 Document Communication]: Document all interactions with your ex-employer, including emails, phone calls, and in-person meetings. This documentation can serve as evidence in case further action is required.

3. [🔗 Follow-Up with Labour Commissioner]: If you have not received a response from the Labour Commissioner, consider sending a follow-up email. Clearly outline your situation and attach relevant documents for reference.

4. [🔠 Know Your Rights]: Familiarize yourself with the labor laws and regulations in India, particularly those related to incentives and final settlements. This knowledge will empower you to assert your rights effectively.

5. [💼 Seek Legal Advice]: If the issue persists, consider seeking legal advice from a labor law attorney. They can provide guidance on the best course of action to resolve the matter.

6. [🕒 Maintain Professionalism]: Throughout the communication process, maintain a professional and respectful tone. Clear and concise communication can often facilitate a quicker resolution.

7. [📅 Request a Resolution Timeline]: Politely request a specific timeline for the resolution of the incentive payment issue. This can help set expectations and ensure timely follow-up.

Conclusion

By taking proactive steps, documenting all communication, and seeking appropriate guidance, you can increase the likelihood of resolving the incentive payment matter with your ex-employer successfully. Stay persistent and focused on securing what is rightfully yours.
