I am a consultant from Mumbai. I had sourced a candidate for one of my clients in Karnataka state. That candidate was terminated due to non-performance within 90 days.
So, is the consultant eligible for the payout from the client's end since the candidate was asked to leave from the client's end, and not because the candidate is absconding?
Please revert!

This is a matter between a purchaser and a service provider and is out of the purview of labor laws.
Contractual Agreement
Anyway, before providing your services, did you enter into any contract with the client? If yes, then what is the clause if the candidate is required to be terminated because of underperformance?
Purchase Order Consideration
If not in the contract, has your client issued you a Purchase Order (PO)? If yes, then what is the clause if the candidate is required to be terminated due to underperformance?
Without knowing the facts of the case, no opinion can be provided.
