Hi Everyone, I am currently employed at TCS and deputed to Japan for an onsite assignment. I want to resign from the company due to some personal commitments. Before coming onsite, I signed a service agreement which states, “On return to offshore, I am bound to serve a minimum of 3 months in India.” If I violate this, I am liable to pay an amount not exceeding Rs.5,00,000/-.

Notice Period Clarification

1. I want to know whether the above-mentioned 3 months are the same as the general 3 months notice period?

The service agreement also mentions that the quoted amount would be in addition to USD 30,000 payable by me as liquidated damages as set in the overseas agreement policy.

2. Can anyone explain to me regarding the USD 30,000? Under what circumstances am I liable to pay this amount? I do not have any copy of the Overseas Agreement policy with me.

I am in the same situation, tcs sent me a legal notice that I cannot join client directly. Notice also says, I have to pay $30000 for contract breach. any idea what should I do?

Could you kindly share the latest update. I have resigned tcs and travelled back to india to serve the notice period. My resignation status shows as ‘resign with pay’. Do I have to pay $30000?
