My name is Ankit. I was working with the company for almost 8 years, and after some time, they gave me my gratuity, but they are not providing me with the calculation for the same. At that time, the company was not issuing salary slips, so I don't have any salary slips.

Now, I have learned from some sources that they gave me a lesser amount of gratuity. This is because LIC had released fewer funds, resulting in them having to release a reduced amount to me.

Recently, I requested the calculation for my gratuity (how the company calculated gratuity), but they are not providing me with the calculation. They are simply telling me that my gratuity has been paid as per record.

Now, how can I inquire about my remaining funds?

Dear Ankit, you can calculate your gratuity with the formula: Last drawn basic / 26 * 15 * number of years worked. This will help you determine the difference amount, for which you can draft a letter and send it via registered AD to request a response from the company.

If you are not aware of your salary breakup, you can draft a formal letter and send it via registered AD to the company. If the company does not respond, you may send a legal letter or approach the labor office for further assistance.

Additionally, if possible, you can draft an email to the official email ID of your company and HR department to get the answer. This action can serve as proof of your follow-up with the organization in the future.
