My company is registered in Satana district, Nashik, where ESIC is not applicable. However, now our 6 employees are working in Gurgaon (Haryana) at a project site where ESIC is applicable. So, please guide us on whether we have to register under ESIC in Haryana or not.

Dear Phogat,

If your office is deputing these employees to Gurgaon for work and salary is being processed from your location, then it is not required. If you have an office in Gurgaon and process the salary of the employees, then ESIC is applicable once the count reaches 20 employees.

Dear Phogat ji,

My answer to your query is as follows:

If your project site is covered under the ESI Act, and your employees working at the project site are eligible under ESIS, you need to cover them under ESIS regardless of whether you have employees below the threshold limit or are not registered under ESIS.

In this scenario, you must cover your employees under the code of PE and ensure proper compliance. Since you have employees below the threshold limit, you will not receive a code number.
