Dear All, I am working in a private company in Madhya Pradesh. The management is not agreeing to provide leave encashment, and they are saying there is no rule for the accumulation of leaves. I showed them the rule, but I am unable to find where it is mentioned about the minimum number of leave accumulation in the M.P. Shop and Establishment Act. Management is saying they will allow only 10 leaves accumulation in a year. What shall I do? Please provide a copy of the rule where it is mentioned about the minimum number of leave accumulation. Also, please let me know if there is a rule for the minimum number of leave encashment.

Leave accumulation and encashment are company policy-driven. However, as per the act/rule, the employer is supposed to allow the employee to avail leaves, and in case of refusal, pay compensation.
