Addressing Delayed Salary Disbursement: Legal Remedies and Labor Officer Complaint - CiteHR

Salary Payment Delays in Our Manufacturing Company

Our company is a manufacturing company. The company used to pay salaries regularly on the 10th of every month. However, for the last 3-4 years, we have not been paid on time. The payments are consistently made after the 25th of every month. The management shows minimal concern in informing the employees about the delays. Most of the employees earn salaries greater than 10,000 Rs.

Inquiries and Management's Response

We are required to inquire with the management about our salaries every month. The response we receive is that we will be paid once the funds are available. Our December 2015 salary remained unpaid until September 2017. This situation is testing our patience, leading many of our colleagues to leave the company.

Seeking Legal Guidance

Could anyone please guide us on the legal options we have? Thank you in advance.

Dear Kiran, Earlier, employees of your company rationalized the delay in receiving their salaries. Over time, this delay has been institutionalized and become part of the company culture. However, it is imperative that you put a stop to this illegal practice. It is surprising that you have tolerated this delay for so long.

Therefore, all of you can collectively approach the labor officer in your area to address the delay in monthly salary disbursement. At this point, this is the most economically viable remedy available. Please note that there are no fees required for filing a complaint with the labor officer.

Thanks,
