Employee Resignation and Notice Period Issue

We have a situation where an employee, who worked with us for the last 18 months, resigned. After her resignation, she started sending information from her company email address to her personal email address. Once we became aware of this, we asked her to leave for the day.

Following this incident, she did not report to work. Two to three days later, we sent her an email asking why she was not reporting to work. She replied that she was asked to leave the office and treated this as a relieving.

Subsequently, she has been writing emails and calling, asking for her salary and experience documents. What should we do as she did not serve the notice period and has not been formally relieved from the company?

Hi,

You may ask her to serve the notice period or to compensate in lieu of to avail employment documents. Non-adhering to the same shall be treated as NCNS, and you can send in a "show-cause notice" and close that. However, any salary pending for the time she worked has to be paid over F&F.
