Is it mandatory to avail ESI benefit under the new wage limit of ₹21,000 for our old members? If they don't want to get this, is it possible?

The notification for the new wage limit of INR 21,000 has not yet been released. Therefore, you should hold on for the time being. In case of any queries, you may contact your ESIC office number and check.

The Gazette notification is yet to be released. Once it is released, the same is applicable for all the employees (including existing employees and new employees). No one can avail exemption from ESI benefits if he/she is earning 21000/- or less.

Yes, Notification not received yet. may be it will be effective from November 16. also we are looking for changes in Emmloyee/Employers contribution may be reduced by ESIC. Regards Dwarika P Nautiyal

In our earlier gazette notifications, the enhancement of the wages limit under the ESIC legislation is prospective, not retrospective. Therefore, any gazette not published before 30.09.2016, can be treated as not implemented. You can continue to recover ESIC Contribution on Rs. 15K only for the next six months.

Moreover, if an employee is injured in an accident during employment hours (from leaving home in the morning until reaching home in the evening), all expenses and leave compensation will be covered by ESI.

1. Educating or conducting bulk training sessions about the importance of ESI, its benefits, and comparing ESI with other private medical insurances. This information was also shared with non-ESI employees for knowledge sharing.
2. Assisting employees in accessing benefits from ESI.
3. Contacting ESI to organize a Permanent Card Biometric Camp at the office. If the employee strength is more than 50, ESI representatives will come. They can also conduct sessions for employees to explain the benefits of ESI.
4. Encouraging employees to see the benefits for themselves. Focusing on the employer's contribution may not be as convincing.
After taking these steps, many non-ESI employees have expressed their willingness to join ESI. This latest news will bring them joy. Of course, some employees may not like it, especially if they have never used ESI or other medical insurances.
