One of the MNC Pharma companies in India, based in Gurgaon, is avoiding layoff or retrenchment policies and threatening employees to resign or else be terminated with one month's notice. Those who are working are in the workmen category but do not have any idea of ID Act protection.

Filing an RTI to the Labour Commissioner

Can I file an RTI to the Labour Commissioner of the concerned head office area to know about mass resignations and the reason for such resignations? Could it be possible to get an RTI to prove that mass resignation is actually reflecting the naked hire-and-fire system?

1. Sir, under the provisions of the RTI Act, 2005, you can request copies of information/documents that are available in the records of any government authority. The RTI Act does not apply to private persons/companies.

2. However, even from 'authorities,' you cannot ask questions and, in my opinion, you cannot request reasons, etc.
