Dear Seniors, Pls guide me how to design leave policy for people under probation. Best regards Uma

Hi Uma, in most organizations, only 1 CL per month is allowed for probationary employees. Their earned leave accumulates until the employee is confirmed, and only then can they avail of the leave. If more than 1 leave is taken before confirmation, it is counted as LWP.

Hi Uma, As far as I know no paid leaves are allowed during probation period. Employees are allowed to take paid leave only after confirmation.

Both options (either one day per month OR no leaves) exist in the industry. One point to bear in mind is that during the confirmation of an employee in probation, their attendance also plays an important role. Hence, restricting the leaves provided during probation would be helpful.

Hi Uma, it depends on company policy. In my company, 1.5 leaves per month are given to each employee, whether in probationary or confirmed status. However, last month, I was selected as AM (HR), and no leaves are allowed for six months (Probation Period).

You have not mentioned the type of your company. If it is a factory, one will be eligible for earned leave (EL) only on completion of 240 days in the previous year. The Factories Act is silent about other leaves, which depend on the company policy. If it is a commercial establishment, provide leaves as per the Shops and Commercial Establishments Act of your state.

It depends upon one's company policy. If it is a factory, as per the Factory Act, every twenty days of continuous working, one day is credited to one's paid leave account. This means one has to earn leave during their tenure, even when they are on probation. In addition, one can avail of Casual Leave (CL) as per the company's policy on a proportionate basis according to the joining date in a calendar year. I hope this is clear on the subject.
