Do we need to take prior permission for giving overtime to workmen? If yes, what is the procedure for obtaining such permission? Is any separate permission required to be taken in case work is extended to 12 hours continuously?

Please note that for overtime within the prescribed limit, which is not more than 10 hours including OT per day, not more than 60 hours including OT per week, and not more than 50 hours of OT in a quarter, you do not need to seek permission. However, please remember that you are required to pay overtime at twice the normal hourly rate.

The Chief Inspector of Factories/Joint Director of Health & Safety has the authority to grant exemptions related to daily working hours, which shall not exceed 12 hours spread over 13 hours, weekly hours not exceeding 60 hours including overtime, and quarterly overtime not exceeding 75 hours. These exemptions are subject to the discretion of the authority. Generally, decisions are made based on the nature of the industry, specifically whether it involves continuous operations where continuous manning is critical from both production and safety perspectives.
