Hi all,

One of my friends is working for a good company. It has only been 3 months since he joined that company, but now he is not interested in the job profile and is planning to join a new company. Since he is in the probation period, what will be the notice period? In his offer letter, it has been mentioned that services can be terminated on either side without any notice. However, he is worried about whether the management will accept his decision or ask him to serve a notice period. How valid is this concern? Can they reject his relieving letter, or what can he do if they don't accept his resignation?

Please provide your suggestions as this is very urgent.

If the Offer/Appointment Letter states that "during probation, termination can be from either side, without notice," it means he too can put in his papers anytime he feels so. I don't see any problem here. The company cannot refuse him the relieving letter.

However, in all safety, he should first put in his resignation via email and cc his personal ID. This way, he will have a copy of the same with him. He can show the same as evidence to his prospective employer, which shall act as a document of his relieving duties at his current employment.

During probation, an employee is not required to give a notice period. Management should relieve him within one day. However, the resigning employee must officially hand over his responsibilities to another person before being relieved. It is always better to follow this process. By following this procedure, the resigning employee will be relieved. This process typically takes about a week to complete. Demonstrating professional behavior in such situations can greatly benefit individuals in the near future.

Hi!

During the probation period, resignation may be accepted as per company rules and conditions. Some companies require a 1-month notice period, so the notice period depends upon the company's policy. I suggest you contact the HR department in this regard, or you can find the resignation and relieving formalities in our company policy book.

In my case, the terms and conditions were not attached to the letter. After resigning, I came to know about the notice period. However, they have taken my signature on the copy of terms and conditions, stating that they will provide the copy afterwards.

But they cannot deny the relieving letter since he worked in that company for 3 months and have records for that. So ask your friend not to worry and put the papers without any fear.

Since, He Is On Probation, There Is No Need To Worry, If He Gets The Good Job He Can Switch Over, He Will Be Relieved In One Day.

Hi all,

I read your discussions, but I have a small question on relieving. What are the things to be observed during the exit clearances other than the dues settlement? Is there any law permitting the relieving paper to be given after 7 days from the day the employee relieves?

The situation why I ask this question is, some employees break some instruments or repair them on the last working day without our notice. When we come to know, it's late as they must have been relieved with the relieving papers nicely. So, I want to know whether any rule or law permits giving the relieving papers after 7 days from his last working day? Please help out, friends.
